B. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that:

You own or have the necessary licenses, rights, consents, and permissions to use and authorize X1 Racing Group to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the X1 Racing Group Platforms and these Terms of Service; and
You have the written consent, release, and/or permission of each and every identifiable individual person in the User Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the User Submissions in the manner contemplated by the X1 Racing Group Platforms and these Terms of Service. For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting the User Submissions to X1 Racing Group, you hereby grant X1 Racing Group a worldwide, non-exclusive, royalty-free, sub-licenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the X1 Racing Group Platforms and X1 Racing Group’s (and its successor’s) business, including without limitation for promoting and redistributing part or all of the X1 Racing Group Platforms (and derivative works thereof) in any media formats and through any media channels. encourage conduct that would constitute a criminal offense, or that gives rise to civil liability;
use the X1 Racing Group Platforms in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party’s use and enjoyment of X1 Racing Group Platforms. You will not attempt to gain unauthorized access to any services, user accounts, computer systems or networks, through hacking, password mining or any other means. We may take any legal and technical remedies to prevent the violation of this provision and to enforce the Terms;

X1 Racing Group does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and X1 Racing Group expressly disclaims any and all liability in connection with User Submissions. X1 Racing Group does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and X1 Racing Group will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another’s intellectual property rights. X1 Racing Group reserves the right to remove Content and User Submissions without prior notice. X1 Racing Group will also terminate a User’s access to its Website, if they are determined to be a repeat infringer. A repeat infringer is a User who has been notified of infringing activity more than twice and/or has had a User Submission removed from the Website more than twice. Step #1: The friendly warning. This is where we give you the benefit of the doubt. Maybe you didn’t realize that what you were doing was in violation of our policies. Or maybe you did realize, but it’s not too late for us to show you the error of your ways. Regardless, this should be the last time we have to discuss it with you.

Step #2: The strong warning. Perhaps we didn’t make ourselves clear? This is us giving you one more chance to change your violating ways before we take serious action.
